Terms & Conditions

1. Definitions

• "User" / "you": Any person who accesses or uses the App.
• "Pet Profile" / "Digital Identity": The digital profile you create for a pet.
• "User Content": Any content you submit, upload, or generate via the App, including threads/posts, comments, votes (upvotes/downvotes), product likes/dislikes, reports, pet names, and pet photos.
• "Community Content": User Content visible to other logged-in users (threads/comments and related interactions).
• "Community Insights": Aggregated or summarized information derived from community activity (e.g., "pets like yours liked this product," counts by breed/age/weight/gender/etc.).
• "Products": Third-party goods displayed in the App via affiliate XML feeds and linked to third-party stores.
• "Third-Party Services": Services not operated by us (e.g., ad providers, translation providers, store websites).

2. Eligibility (16+)

You must be at least 16 years old to use Identitail. By using the App, you represent and warrant that you are 16+ and legally able to enter into these Terms. If you are not 16+, you may not use the App.

3. Account registration, security, and responsibility

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate account information and keep it updated where applicable.
• If you suspect unauthorized access, you must notify us promptly at identitail.app@gmail.com.
• We may suspend or terminate accounts for security or policy reasons as described below.

4. Nature of the Service

Identitail provides:

• Pet "digital identity" profiles (including pet attributes and pet photos).
• A community feature where logged-in users can view, create, and interact with threads and comments.
• Product browsing via affiliate feeds, including community-driven likes/dislikes and Community Insights.
• Optional content translation features (through Third-Party Services).
• Reporting tools for inappropriate content or behavior.

Community visibility: Threads and comments are available only to logged-in users, but may be visible to any logged-in user depending on searches and filters. Pet names are displayed in threads and comments.

No direct messaging currently: Identitail does not currently provide direct user-to-user messaging. We reserve the right to add messaging or other social features in the future (Section 18).

Analytics & crash reporting: If you have provided consent, the App automatically collects anonymized usage analytics (e.g., app opens, session length) and crash reports to improve stability and the user experience. See our Privacy Policy for details.

Push notifications: The App may send you push notifications (e.g., updates, reminders, or activity alerts). On Android 13 and above, we will ask for your explicit permission before sending notifications. You can enable or disable notifications at any time via the App's Settings screen or your device's notification settings. Disabling notifications does not affect any other App functionality.

5. User Content and conduct rules (Strict)

You agree that you will not post, upload, share, or otherwise make available any User Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy.
• Is hateful or discriminatory (including based on protected characteristics).
• Promotes violence, illegal activity, self-harm, or cruelty.
• Contains sexual exploitation, especially involving minors (zero tolerance).
• Infringes intellectual property rights (copyright, trademarks) or other rights.
• Includes personal data of others without permission (doxxing), or attempts to obtain sensitive information.
• Is spam, scam, misleading, fraudulent, or deceptive (including vote manipulation).
• Contains malware, harmful code, or attempts to disrupt the App.
• Impersonates another person/entity or misrepresents affiliation.

You also agree not to:

• Attempt unauthorized access to systems/accounts.
• Reverse engineer or circumvent security (to the extent allowed by law).
• Use automated scraping/botting that harms service integrity.
• Interfere with community moderation or reporting systems.
• Use the App for any commercial purpose not expressly permitted by us.

6. Reporting, moderation, and enforcement

Users can report threads, comments, or users via standard reporting categories. You understand and agree:

• We may (but are not obligated to) review reports and take action.
• We may remove content, restrict features, suspend, or terminate accounts at our discretion to protect the community and the App.
• We do not guarantee outcomes, response times, or that all content will be removed.
• We may act without notice where necessary for safety, compliance, or operational reasons.

7. User Content ownership and license to us

You retain ownership of your User Content, subject to the license you grant below.

To operate and provide Identitail, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to: Host, store, use, reproduce, modify (for formatting/technical delivery), display, distribute, and create derivative works of your User Content solely for:

• Operating, maintaining, and improving the App.
• Enabling community features (displaying threads/comments, showing pet names).
• Generating and displaying Community Insights (aggregated counts/statistics).
• Marketing and promoting the App (e.g., showing screenshots of public threads).
• Enforcing policies, preventing abuse, and handling reports.

This license continues until your User Content is deleted from the App, except that:

• Content shared with others may persist in their views (e.g., quoted/reposted where supported).
• Content may remain in backups for a limited period.
• We may retain limited records for legal, security, and abuse prevention purposes.

7.1 Copyright Infringement

We respect intellectual property rights. If you believe content on the App infringes your copyright, please contact us at identitail.app@gmail.com with details of the alleged infringement. We will respond to valid notices and remove infringing content where appropriate.

8. Product listings, affiliate feeds, and third-party stores

8.1 Source of product data: Products are displayed from affiliate XML feeds provided by third-party stores. We do not manufacture, sell, ship, store, or warranty products.

8.2 Affiliate links: When you click a store link, you leave Identitail and interact with a third-party website. Your purchases and interactions are solely between you and the store. The store's terms and privacy policy apply.

8.3 No sponsorship: Identitail does not accept paid sponsorship to influence product ratings or Community Insights. Product likes/dislikes and related summaries are community-driven.

8.4 No guarantee of accuracy: Product information (availability, price, descriptions, images) may be incomplete, outdated, or incorrect. We do not guarantee accuracy.

9. Community Insights are informational only (NO advice)

Identitail may display community-driven statistics, comparisons, and summaries such as "pets like yours liked this." You acknowledge and agree:

• Community Insights reflect user behavior, not professional judgment.
• Community Insights and Community Content are not veterinary, medical, nutritional, training, safety, or professional advice.
• You are solely responsible for evaluating products and making decisions for your pet.

10. Assumption of risk (pet health and product use)

To the maximum extent permitted by law, you expressly assume all risks arising from:

• Your reliance on any Community Content or Community Insights.
• Your purchase, use, misuse, or inability to use any product displayed or linked in the App.
• Interactions with other users.
• Outcomes affecting your pet's health or safety.

Identitail is an informational, community-driven platform. You accept full responsibility for your pet, including supervision, product selection, and outcomes.

11. Third-Party Services

The App may integrate Third-Party Services (e.g., advertising services and translation services). We do not control Third-Party Services and are not responsible for their content, availability, security, or actions. Your use of Third-Party Services may be subject to their terms and policies.

12. Intellectual property & Feedback

12.1 App Ownership: All rights, title, and interest in the App (excluding User Content), including software, design, trademarks, and branding, belong to Melis Sakić and/or licensors. You may not copy, modify, distribute, sell, lease, or create derivative works from the App except as permitted by law or by written permission.

12.2 Feedback: If you choose to submit comments, ideas, or feedback, you agree that we are free to use them without any restriction or compensation to you.

13. Prohibited reliance / Medical disclaimer

Identitail does not provide veterinary services. No content in the App creates a veterinarian-client relationship or substitutes for professional advice. If your pet has urgent health concerns, contact a veterinarian immediately.

14. Disclaimer of warranties ("AS IS")

To the maximum extent permitted by applicable law, the App and all content, Community Insights, and product information are provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and that the App will be uninterrupted, error-free, or secure.

15. Limitation of liability

To the maximum extent permitted by applicable law, Melis Sakić will not be liable for any:

• Indirect, incidental, special, consequential, exemplary, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business interruption.
• Pet-related harm, injury, illness, adverse reaction, or damages of any kind.
• Damages arising out of or related to the App, User Content, Products, or Third-Party Services.

Total liability cap: To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the App will not exceed 50 BAM (or the equivalent of €25) in aggregate.

16. Indemnification

You agree to defend, indemnify, and hold harmless Melis Sakić from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App.
• Your User Content.
• Your purchase/use/misuse of any product displayed or linked in the App.
• Your violation of these Terms or applicable law.

17. Termination

By you: You may stop using the App at any time. You may delete your account in the App's Privacy & Security section.

By us: We may suspend or terminate your access at any time if you violate these Terms, if your conduct creates risk/exposure, or for operational reasons.

Survival: Sections 7–16 and 19–23 shall survive termination.

18. Future features & Service changes

Paid features: We may add optional paid features/subscriptions in the future. Specific terms will be provided at the time of purchase.

Messaging: We may add social features in the future. Additional safety rules may apply.

Changes: We may change, suspend, or discontinue any part of the App at any time without liability.

19. Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation, acts of God, war, or natural disasters.

20. Governing law and Jurisdiction

These Terms are governed by the laws of Bosnia and Herzegovina. You agree that any dispute, claim, or controversy arising out of or relating to the App or these Terms shall be brought exclusively in the competent courts located in Tuzla, Bosnia and Herzegovina.

21. Severability & Entire Agreement

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement: These Terms, together with the Identitail Privacy Policy, constitute the entire agreement between you and us regarding the App.

22. Changes to these Terms

We may update these Terms at any time. If a revision is material, we will provide notice via the App or email. By continuing to use the App after those changes become effective, you agree to be bound by the revised Terms.

23. App Store Provisions (Apple & Google)

If you downloaded the App from the Apple App Store or Google Play Store, the following applies:

• These Terms are concluded between you and Identitail only, not with Apple or Google.
• Apple and Google are not responsible for the App or its content.
• Apple and Google have no obligation to furnish any maintenance or support services with respect to the App.
• You represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
• Apple and Google are third-party beneficiaries of these Terms and have the right to enforce them against you.
